INTRODUCTION

The "Saavn Ring Tone Sweepstakes" (the "Sweepstakes") is sponsored by Saavn, LLC (referred to herein as "Sponsor"), 72 Madison Ave, New York, NY 10016. The Sweepstakes begins on or about 9:01 PMEastern Time ("ET") on December 16, 2008 and the deadline for receipt of entries for the Grand Prize (defined below) drawing is 11:59 PM ET on January 1, 2009 ("Entry Period"). Entries received before and/or after the Entry Period will be void. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these "Official Rules" and the decisions of Sponsor, which will be final and binding in all respects.

HOW TO ENTER

THERE ARE TWO (2) WAYSTO ENTER: Entrants may enter the Sweepstakes online or via text message:
To Enter For Free Via the Internet: Visit http://www.chandnichowktochinamovie.com (the "Website") and follow the on-screen instructions to complete and submit the entry form. Entrants will be asked to submit a completed official online entry form, which may include, e-mail address and related registration information as prompted. Information collected from entrant on the online entry form will only be used to contact entrant to notify them if he or she has won. In the event of a dispute as to an online entry, the authorized account holder of the e-mail address used to enter the Sweepstakes will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Winner may be required to show proof of being the "authorized account holder." Proof of entering information at Website does not constitute proof of delivery or receipt.
To Download The Ring Tone and Enter Via Text Message: If you are a wireless service subscriber and have a multimedia message service ("MMS") capable mobile phone, you will be automatically entered into the Sweepstakes if you download the ring tone. In order to download the ring tone to your mobile device, text CC2C to the short code 62407. If you download the ring tone, you will be charged the following fee: One Dollar and Ninety Nine Cents ($1.99) (USD). Further, if you download the ring tone, you may also be charged standard text and data rates for each text/MMS message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Normal airtime and carrier charges may apply to download of the ring tone and will be billed on the entrant’s wireless phone bill or deducted from their pre-paid balance. Each wireless carrier's rate plan may vary, and entrants should contact their wireless carrier for information on messaging rate plans and charges relating to your participation in this Sweepstakes. Participation in this Sweepstakes by mobile phone and text message means that you understand and agree that you may receive additional text messages from Sponsor relating to this Sweepstakes, including to notify you if you are a potential winner in the Sweepstakes, which will be subject to the charges pursuant to your carrier's rate plan. Entrant must use a mobile device capable of two (2)-way messaging. Text messaging may not be available from all mobile phone service carriers and handset models.
All entries become the property of Sponsor and will not be acknowledged or returned.
Limit one (1) entry per person regardless of the method of entry during the Entry Period.
Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Sponsor and its agents are not responsible for lost, late, or misdirected entries, for technical, hardware or software failures of any kind, for lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer transmissions or any human error which may occur in the receipt or processing of the entries.
Use of computer programs, macro, programmed, robotic, automatic and other similar means to enter the Sweepstakes is prohibited and may result in the disqualification of the entrant.
In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible.
The Website’s database clock will be the official time keeper for this Sweepstakes.

WINNER SELECTION

In order to be eligible to win the Grand Prize, entrants must complete all information on the entry form on the Website and submit the entry form through the Website or download the ring tone correctly to their mobile device.

The potential Grand Prize winner will be selected in a random drawing from among all eligible entries received during the Entry Period.
The random drawing will be conducted by Sponsor-selected judges, whose decisions are final on all matters relating to the selection of the winners of this Sweepstakes.
Odds of winning depend on the number of eligible entries submitted.
The Grand Prize drawing to be held on or about 12:00 PM ET on January 2, 2009.
The potential Grand Prize winner will be notified within twenty-four (24) to forty-eight (48) hours of the drawing by telephone. Due to the short time frame between the drawing and the dates of the Grand Prize trip, if the potential Grand Prize winner does not answer the telephone call notifying them they won the Grand Prize, such Grand Prize winner will be disqualified and Sponsor may select an alternative potential Grand Prize winner by random drawing. This process will be repeated until such point in time as a potential Grand Prize winner answers their telephone and orally accepts the Grand Prize and fulfills the other requirements set forth below.
Before receiving the Grand Prize and as a condition of receiving such Grand Prize, the potential Grand Prize winner (and potential Grand Prize winner's guest) will be required to complete and return an affidavit of eligibility and a liability and publicity release within twenty-four (24) hours of attempted delivery. Due to the short time frame between the drawing and the dates of the Grand Prize trip, the potential Grand Prize winner must have an e-mail address where the prize acceptance documents can be sent.
If the Grand Prize winner fails to sign and return the required documents within twenty-four (24) hours of receipt of the notification letter by e-mail (with PDF attachment) or by fax, does not accept the Grand Prize, or fails to meet any eligibility requirement herein, an alternate potential Grand Prize winner will be chosen by random drawing to be held as soon as reasonably practicable thereafter. The alternate potential Grand Prize winner is subject to all eligibility requirements and restrictions of these Official Rules.
If any prize, prize notification or Sweepstakes-related communication is rejected, faulty, or returned as undeliverable or if a potential Grand Prize winner cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), that potential Grand Prize winner will be disqualified and an alternate potential Grand Prize winner will be randomly selected. An alternate potential Grand Prize winner will be selected from all eligible entries received for the original drawing, and Sponsor shall repeat the Grand Prize winner selection and notification procedures set forth in this Section until a qualified Grand Prize winner has been selected.

GRAND PRIZE DETAILS

One (1) Grand Prize winner will be randomly selected from all qualifying entries by Sponsor representative or its designee, the judge of the Sweepstakes, whose decisions are final and binding on all matters relating to the Sweepstakes. No substitution, cash equivalent or transfer of the Grand Prize is permitted except at the Sponsor's option. The Grand Prize winner will receive the following "Grand Prize":

A two (2) night trip from January 7, 2009 through January 9, 2009 for the winner and one (1) guest to attend the New York premiere of "Chandni Chowk to China" and potentially meet Akshay Kumar (subject to his availability), including a two (2) night hotel stay (one (1) room based on double occupancy) for the Grand Prize winner and one (1) guest. The Grand Prize trip includes: (1) roundtrip coach air transportation for the winner and one (1) guest to New York, New York from a major commercial airport (selected by Sponsor in its sole discretion) near Grand Prize winner’s home via a major carrier that services New York (selected by Sponsor in its sole discretion) and transfers to/from the hotel and airport in New York. All travel arrangements must be made through the Sponsor. Certain restrictions and black out dates may apply. The total approximate retail value of the Grand Prize trip is Two Thousand Dollars ($2,000) (USD). The meeting with Akshay Kumar is of no tangible value and is subject to his availability and may be substituted in Sponsor's sole discretion if he is unavailable to meet with Grand Prize winner with an autographed poster signed by a cast member of "Chandni Chowk to China". The Grand Prize trip must be taken at time and flight itinerary specified by Sponsor in Sponsor's sole discretion or Grand Prize will be forfeited in its entirety and a replacement Grand Prize winner will be selected by Sponsor from among the remaining eligible entries. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. All travel dates are subject to change in Sponsor’s sole discretion. Air travel and hotel accommodations are subject to availability and any changes made to either of these will be at the expense of the Grand Prize winner. Grand Prize winner and guest will be required to travel together on the same itinerary and be responsible for obtaining all required travel documents. Grand Prize winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. The winner of the Grand Prize may be required to provide a credit card at the time of hotel check-in. Guest traveling with Grand Prize winner must be at time of Grand Prize fulfillment the age of majority in the jurisdiction in which s/he resides. If Grand Prize winner is not the age of majority in the jurisdiction in which Grand Prize winner resides, s/he must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the allotted guest. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. Lost, stolen or damaged airline tickets will not be replaced or exchanged. The Sweepstakes Entities (defined below) shall not be liable for any loss or damage to (a) any baggage or any unauthorized intervention whether or not caused by any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity(ies), equipment failure, including overloading of the website due to excessive use, threatened terrorist act(s), terrorist act(s), air raid(s), blackout(s), act(s) of public enemy, earthquake(s), war(s) (declared or undeclared), fire(s), flood(s), epidemic(s), explosion(s), unusually severe weather, hurricane(s), embargo(s), labor dispute(s) or strike(s) (whether legal or illegal), labor or material shortage(s), transportation interruption(s) of any kind, work slow-down(s), civil disturbance(s), insurrection(s), riot(s), or any other similar or dissimilar cause(s) beyond Sponsor’s sole and reasonable control; (b) damage caused by computer virus or otherwise resulting to any computers from any entrant’s access to the Website or entry into the Sweepstakes; (c) printing or other errors appearing in the rules or other Sweepstakes materials; (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any entrant's participation in the Sweepstakes or receipt or use of any prize. The Sweepstakes Entities shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any performer(s)/event(s), air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Grand Prize winner's and his/her travel companion transportation and such contracts shall be solely between the Grand Prize winner, his/her travel companion and such transportation companies. The Sweepstakes Entities shall not be parties to such contracts and shall assume no responsibility in this connection. The Sweepstakes Entities shall not be liable for any loss, theft or damage of cash, cameras, jewelry, securities, heirlooms, negotiable papers or other valuables. If the Grand Prize winner becomes disabled or cannot otherwise fully enjoy the Grand Prize travel package due to illness, Sponsor shall have the option of: (1) being relieved of liability for fulfillment of the Grand Prize award; or (2) at Sponsor's sole discretion extending the period during which the Grand Prize may be awarded for a period equal to the duration of the Grand Prize winner's disability or illness, in which case certain prize components may not be available. The Grand Prize winner must prove such disability by a doctor's certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Grand Prize winner at Sponsor's expense. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision; you further agree that in any cause of action, the Sweepstakes Entities' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Entities be liable for attorneys' fees and/or experts' fees and costs. By participating in the Sweepstakes, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. The stated ARV of the Grand Prize is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The Grand Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive. The Grand Prize winner must provide Sponsor with a valid taxpayer identification number or social security number before the Grand Prize will be awarded for tax reporting purposes.

ELIGIBILITY

Entrants must be at least twenty-one (21) years of age or older as of December 16, 2008 to participate in the Sweepstakes.
Individuals who, prior to the awarding of prizes in this Sweepstakes, have won another prize from either Sponsor or its affiliates during the preceding three hundred sixty-five (365) day period in which prizes for this Sweepstakes are awarded are not eligible to win this Sweepstakes.
The Sweepstakes is only open to natural persons who are legal residents of one (1) of the fifty (50) United States or the District of Columbia (excluding Alaska, Hawaii, Puerto Rico, all U.S. territories and possessions and all overseas military installations).
Employees of Sponsor and Warner Bros. Entertainment, Inc. and each of their respective parents, subsidiaries, affiliates, directors, officers, governors, distributors, advertising and promotional agencies (collectively, the "Sweepstakes Entities"), their immediate family members and/or those living in the same household of each (whether legally related or not) are not eligible to enter or win.
Void where prohibited by law.

GENERAL CONDITIONS

By entering, entrant agrees to hold harmless, defend and indemnify the Sweepstakes Entities from and against any and all claims, demands, liability, damages or causes of action (however named or described) losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the Sweepstakes or (ii) entrant's participation in any prize-related activities (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)).
By participating in the Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the judges.
Warner Bros. Entertainment Inc., and each of their parents, affiliates and subsidiaries are not responsible for the promotion, administration or execution (including prizing) of this Sweepstakes
Entry in the Sweepstakes constitutes permission to use the Grand Prize winner's name and/or likeness (including his/her voice, biographical information, city and state of residence, statements, and/or photograph(s)) for advertising and promotional purposes by Sponsor, and their respective parents, subsidiaries, affiliates directors, officers, governors, employees and agents, without further authorization, compensation, or remuneration, except where prohibited by law.
The Grand Prize winner may be required to produced valid government issued picture ID for proof of identification and age twenty-one (21) years or older.
The Grand Prize winner is responsible for all local, county, state and federal taxes applicable to the Grand Prize.
The Grand Prize winner must meet all criteria set forth in these Official Rules or face forfeiture of the Grand Prize, based upon the sole discretion of Sponsor.
If for any reason the Sweepstakes is not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right to disqualify any individual it finds who tampers with the entry process, operation of the Sweepstakes or Website, and to cancel, terminate, modify, or suspend the Sweepstakes without notice and to select the winner from all eligible entries received prior to the cancellation or termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, problems or technical malfunctions of any computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of human error, technical problems or traffic congestion on the Internet or at any Website, theft or destruction, or unauthorized access to, or tampering with or hacking of Website, any combination thereof, or otherwise, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation in the Sweepstakes. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
By participating in the Sweepstakes, entrants accept and agree to these Official Rules and the decisions of the judges, which shall be final and legally binding.
This Sweepstakes is subject to all applicable federal, state, provincial and local laws.
Sponsor shall be entitled to interpret these rules as needed, including, but not limited to, rules regarding entries, selection of winner, deadlines, restrictions on the prize, and eligibility - and all of its decisions are final. By entering, you agree to these conditions.

THE SWEEPSTAKES AND PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

GOVERNING LAW/JURISDICTION

The Sweepstakes and these Official Rules are governed by and shall be construed in accordance with the substantive laws of the Sate of California (as distinguished from the choice of law rules) and the United States of America applicable to contracts made and performed entirely in California and where the relevant contacts are with such state. All applicable federal, state, and local laws and regulations apply. Except where prohibited, as a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, the prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees and expert fees and costs, other than entrant’s actual out-pocket expenses, and entrant further waives all rights to have damages multiplied or increased.

DISPUTE RESOLUTION

The parties agree that any disputes arising out of these Official Rules shall be submitted to final, binding arbitration conducted in Los Angeles County under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. (“JAMS”) before a single, neutral arbitrator who is a former or retired California state or federal court judge with experience in entertainment matters who shall follow California law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Los Angeles County, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, the Sweepstakes Entities shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of Los Angeles County. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Los Angeles County.

LIMITATION ON LIABILITY

You agree that the Sweepstakes Entities will not be liable for any injury, loss or damage of any kind (including, but not limited to damage to, computer equipment) resulting from participation in this Sweepstakes, downloading, or the acceptance or use of the prize. You further agree that the Sweepstakes Entities are not responsible for typographical or other errors in the offer or administration of this sweepstakes, including, but not limited to, errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prize.
If for any reason this Sweepstakes, or any portion thereof, is incapable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, strike, act of God, or any other cause beyond the control of Sponsor, Sponsor reserves the right, at its sole discretion and without obligation or prior notice, to cancel, terminate, modify or suspend the affected part of the Sweepstakes.

WINNERS LIST/OFFICIAL RULES REQUESTS

The Grand Prize winner's name will be available on January 2, 2009by sending a self-addressed stamped envelope to: WINNERS’ LIST, Saavn Ring Tone Sweepstakes, c/o Saavn LLC, 72 Madison Ave, 5th Floor, New York, NY 10016.
The Grand Prize winner's name will be posted on the winners' page on the Website for a minimum of sixty (60) days, after which it may be removed. The Grand Prize winner's name also may be posted on the other websites and print publications.
